The Director of Public Prosecutions (DPP) has successfully opposed a fresh bid by former Kiambu Governor Ferdinand Waititu to have his 12-year prison sentence reviewed.
The court ruled against Waititu’s application, affirming that his sentence will stand while his appeal is being processed.
Lady Justice Lucy Njuguna delivered the judgment on 16th September 2025, dismissing an application filed just weeks earlier, on 28th August.
In this application, Waititu sought to overturn the sentence imposed on him in February 2025 following his conviction on corruption charges.
Waititu was found guilty of corruptly receiving Sh25 million from Testimony Enterprises after a tainted tender process.
The court held that he had “failed to uphold the principles of good governance and to safeguard public funds,” resulting in a sentence of either paying a Sh53.5 million fine or serving 12 years behind bars.

Justice Njuguna made it clear in her ruling that Waititu’s sentence would stay in place while his appeal is being processed. She stressed the need for the appeal to be handled quickly, ordering that it be completed within 120 days.
The judge also warned the former governor against any delays, saying that attempts to drag out the process could lead to the appeal being dismissed altogether.
The ruling further pointed out that Waititu had failed to meet the strict bond requirements set by the court, including his inability to produce a Sh53 million bank guarantee. Because of this, he remains behind bars at Kamiti Maximum Prison.
The case is set to be mentioned again in court on 1st October 2025 as the legal proceedings continue. This decision is seen as a major victory for the Director of Public Prosecutions in the fight against corruption in public service.
