The Office of the Director of Public Prosecutions (ODPP) has ordered the arrest and prosecution of two men, both relatives of East Africa Affairs Principal Secretary Abdi Dubat, accused of assaulting a housemaid in Kilimani, Nairobi.
The complainant, Miriam Atieno, alleges that on May 18, her employer, accompanied by his brother, assaulted, tortured, and insulted her during a family dispute. They subsequently forcibly ejected her from the premises and confiscated her personal belongings with the assistance of other family members.
Miriam Atieno sought immediate medical attention at Maria Immaculata Hospital following the incident and reported the matter to Kilimani Police Station, where it was recorded under Occurrence Book number 38/18/5/2024.
The two suspects have been identified as Ibrahim Hussein Omar, who also serves as a personal assistant to the PS, and his brother Ali Hussein Omar, an employee of Kenya Power.
In response to the incident, a group of activists staged three street demonstrations, calling for legal action against the two men accused of assaulting the housemaid.
During the most recent protest on Friday, June 14, the activists marched to the offices of the Inspector General of Police and the ODPP, formally requesting action.
In a letter addressed to Kilimani Police Station, Assistant Director of Public Prosecutions Dorcas Rugut directs the officers to charge the two suspects. The letter, dated June 14, acknowledges the challenges in securing independent witnesses to corroborate the complainant’s allegations due to the assault occurring at a residential premises.
“However, that does not negate the fact that circumstances exist where an offence can be committed without a battery of witnesses to support the sequence of events witnessed,” the letter reads.
An analysis of the P3 form indicates injuries including swelling on the head, tenderness and swellings on the right sternal area, and bruising on the right wrist.
The letter concludes with a directive to “have the suspects charged immediately for the offence of assault causing bodily harm contrary to section 215 of the Penal Code.”
