Ebel Ochieng Kalo, a Lake Basin Development Authority board member currently in custody in connection with the murder of Kasipul MP Charles Were, allegedly threatened to kill a State Prosecutor during a court appearance.
Ochieng appeared before Justice Diana Kavedza at the Milimani Law Courts. According to the prosecution, the suspect threatened to kill Allen Mulama, an officer with the ODPP, prompting the prosecutor to leave the courtroom.
“One of the accused persons, Ebel Ochieng, has threatened to kill the ODPP officer Allan Mulama, forcing the state counsel to excuse himself from court,” the prosecution told the judge.
Justice Kavedza, along with everyone in the courtroom, was left in shock following the accused’s brazen threat against the prosecutor, who was challenging his bond application. As a result, the judge ordered enhanced security measures in the courtroom.
“I take note that the accused person has threatened to kill the prosecutor. The mere utterance of the words ‘huyu tutamuua’—the question is, what about the witnesses? On these grounds, the three are denied bond/bail. The first accused is to be escorted to Mathari Hospital for assessment,” said Justice Kavedza.
The High Court also ordered two other suspects, Isaack Kuria and Allan Omondi Ogolla, to undergo mental health assessments before they are formally charged with murder. Justice Margaret Muigai gave this order during a separate virtual session.
