The immediate former Interior Cabinet Secretary, Kithure Kindiki, has been sworn in as Kenya’s third Deputy President, replacing Rigathi Gachagua, who was impeached by Parliament last month.
Prof. Kindiki’s swearing-in follows the High Court’s decision on Thursday to lift an earlier injunction that had blocked his appointment to the Deputy President position.
A three-judge bench comprising High Court Judges Antony Mrima, Eric Ogola, and Freda Mugambi ruled that the injunction would interfere with the functions and structures of the Constitution by envisioning vacancies in constitutional offices.
“The applications for conservatory orders are disallowed. The conservatory orders issued on 18 October 2024 in Kerugoya High Court are hereby discharged,” the bench stated.

This ruling follows an application filed by Gachagua, who requested the court to extend the conservatory orders that had stopped Prof. Kindiki’s swearing-in as Deputy President.
Gachagua had also faced another setback after the Court of Appeal declined to grant orders preventing the three-judge bench of the High Court from further proceeding with his ouster case.
The impeached Deputy President had appealed to the Appellate Court, arguing that he was dissatisfied with the ruling made by the High Court judges, who declined to recuse themselves from the case, asserting that the bench had been empanelled by Deputy Chief Justice Philomena Mwilu.
In a related development, President Ruto on Thursday appointed Prime Cabinet Secretary Musalia Mudavadi as the Acting Interior Cabinet Secretary, a role held by Prof. Kindiki.
