Businessman Jimi Wanjigi has been released on a Sh10 million personal bond following his Monday arrest and detention at Kamukunji Police Station.
Chief Magistrate Susan Shitubi has scheduled a ruling for 12 September to determine whether Wanjigi will enter a plea or if the charges against him will be dismissed.
During Tuesday’s hearing, Magistrate Shitubi ordered Wanjigi to surrender his passport to the court as a precautionary measure pending the ruling.
This directive aligns with Wanjigi’s legal team’s request for a deferral of the plea.
Wanjigi’s defence, led by Senior Counsel Paul Muite, Wiper Leader Kalonzo Musyoka, and Willis Otieno, argues that the arrest and subsequent charges violate a previous High Court order issued by Justice Bahati Mwamuye.
This order explicitly barred Wanjigi’s arrest and detention, a directive the defence claims has been disregarded by current proceedings.
Muite criticised the legal process, suggesting that it ignored the High Court’s previous ruling and questioned the integrity of the ongoing legal actions.
Otieno further alleged that the Firearm Licensing Board had unlawfully revoked Wanjigi’s firearm licence—a licence previously restored by the High Court—to fabricate charges of illegal firearm possession.
The defence also reported an alleged instance of police brutality involving Wanjigi’s co-accused, Kibe, who, according to Otieno, endured physical abuse while in custody.
