Disc Jockey Joseph Mwenda, alias DJ Joe Mfalme, who was originally accused of the murder of Kabete Police-based DCI officer Felix Kelian, has been acquitted of all charges and is now designated as a state witness.
Following a court ruling on Monday, Mfalme, along with five co-accused, including three police officers, will serve as state witnesses.
The other individuals involved are Eric Kariuki Gathua, Simon Wambugu Wanjiru, Khadija Abdi Wako, Sammy Cheruiyot Rotich, and Agnes Kerubo Mogoiare.
All have been in remand while the police concluded their investigations.
In a letter dated April 5, 2024, the Director of Public Prosecutions directed that Allan Ochieng, also known as Hype Ballo, one of the accused in the assault on Kelian, now face murder charges.
The investigating officer subsequently stated that initial inquiries revealed Kelian’s involvement in a minor car accident near Kikuyu Police Station on March 16 while he was driving a Subaru.
His vehicle hit another car, which had five occupants, and an argument ensued.

A traffic policeman who arrived at the scene discovered the late detective being assaulted. He was taken to Kikuyu Police Station while complaining of abdominal pain and passing blood in his urine.
Kelian was released, but his condition worsened on his way home. He was then admitted to Nairobi West Hospital, where he later passed away on March 21.
When the case was mentioned on Monday, April 8, 2024, it was declared that there was insufficient evidence to prosecute the six, including DJ Joe.
