A petition has been filed at the High Court demanding the Inspector General of Police, Douglas Kanja, to produce, dead or alive, the missing Wajir Assistant County Commissioner and Huduma Centre Manager, Hussein Abdirahman Mohamed, who disappeared on 8 July.
Filed under a certificate of urgency at the Milimani Criminal Division, the application was submitted by lawyers Danstan Omari and Shadrack Wambui, representing Hussein’s family. The petition names the Inspector General, the Attorney General, and the Office of the Director of Public Prosecutions (ODPP) as respondents in the case.
According to court documents, Mohamed was last seen attending an official event in Wajir County that was presided over by Public Service Cabinet Secretary Geoffrey Ruku.
“The applicant was last seen during the event of the visit of the Cabinet Secretary in charge of the ministry of Public Service to Wajir, where he sat among the dignitaries that were welcoming the Cabinet Secretary to Wajir County,” reads part of the petition.
Family lawyers state that Hussein vanished under mysterious circumstances around 10am, and all attempts to trace him have proved unsuccessful. The petition argues that Mohamed’s senior position in public service makes his disappearance highly concerning.
“The status the applicant (Hussein) holds in society, both as an Assistant County Commissioner posted at Wajir County, and the Manager at Huduma Center, Wajir raise questions as to his sudden disappearance, as he is a national figure and a high-ranking public servant, hence cannot have vanished mysteriously and without a trace,” Omari states in the application.

The family suspects he may be held by police or other government agencies and has asked the court to intervene urgently. “That this honourable court certify this matter as extremely urgent and grant production orders of Mohamed before court, as his rights to freedom of movement and association have been illegally, unjustifiably and arbitrarily violated,” the petition adds.
It also details that the family reported the case at Sojir Police Station in Wajir, but the report has not yielded any results. “That the family members of the applicant made a report to the police officers at Sojir Police Station in Wajir County in a bid to get closure on his whereabouts, however the same has borne no fruits yet,” the court documents read.
The petitioners are urging the court to compel IG Kanja, either alone or with the other listed respondents, to produce Mohamed without delay. “That this honourable court be pleased to direct the second respondent (IG), either personally or jointly with the other respondents (AG and ODPP), to immediately and unconditionally present the person Hussein, to be subjected to the rule of law,” reads the application.
The family maintains that Hussein had no known disputes or enemies prior to his disappearance and was carrying out his duties normally at the Huduma Centre.
“Before the unconstitutional, illegal and surreptitious abduction and forceful detention of Hussein incommunicado, he was going about his duties as the manager, Huduma Centre, Wajir, with no feuds and or known enemies or assailants who had ill intentions against him and intended to waylay him for whatever reason,” adds the petition.
The High Court is expected to issue directions on the matter.
