Magarini MP loses seat after Supreme Court upholds annulment

Magarini Member of Parliament Harrison Garama Kombe has lost his seat after the Supreme Court, on Friday, upheld a High Court decision to nullify his election.

A five-judge panel of the highest court affirmed the conclusion that the petitioner, Stanely Kenga Karisa, had satisfied the burden of proof, demonstrating non-compliance with the Constitution and Kenya’s electoral laws.

Mr Kenga contested the seat on the United Democratic Alliance (UDA) party ticket and secured 11,925 votes compared to Mr. Kombe’s 11,946, with a difference of 21 votes.

Dissatisfied with the outcome, Mr Kombe promptly filed a petition with the High Court, seeking to invalidate the results.

After the Court of Appeal upheld the ruling, Mr Kombe sought permission to appeal to the Supreme Court in an attempt to overturn the decision.
