Joseph Irungu alias Jowie has been sentenced to death after he was found guilty of the murder of Monica Kimani in 2018.
While addressing the press after the court ruling, Jowie’s emotional mother faulted the decision, insisting that her son was innocent and was erroneously sentenced.
In expressing dissatisfaction with the sentence delivered by Justice Grace Nzioka, the mother of four exuded confidence that justice would eventually be served and her son would be released at an appropriate time.
She alluded to the bible, believing that the biblical God, whom she serves would help get out her son of prison.
“I believe my son is innocent, he has not done any wrong and has not killed anyone. I believe there is a God of a second chance,” the mother noted.
“My son is like Joseph in the bible who suffered but God helped him. He will be released, that is why I still have the strength that my son will be released when the right time comes,” she added.
Jowie’s mother’s comments came barely minutes after the court sentenced her son to serve the maximum sentence provided for after being found guilty of killing Monica Kimani in 2018.
In her judgement, Justice Grace Nzioka noted that she considered three factors in making her determination.
Among the factors she narrowed down to include; how the offence was committed, the consequence of the offence and Jowie’s personality.
“I have ordered that the first accused person before this court, Joseph Kuria Irungu alias Jowie shall suffer death as provided for the offence of murder under section 204 of the penal code of Kenya” the judge pronounced.
While narrating the nature of the murder, Justice Nzioka noted that Kimani’s killer did not have the intention to give the businesswoman even one minute to live.
“It was a gruesome murder, horrific and threatening,” Justice Nzioka remarked.
Additionally, the Defence lawyer added that the family of Jowie is extremely dissatisfied with the verdict of the court to hand down a sentence to their son.
The lawyer stated they have since prepared a notice of appeal and will officially file the same at the Court of Appeal after a consultative meeting with Jowie’s family.
“When she was passing the sentence we affirm that in this entire process justice Nzioka was playing to the gallery aiming at painting jowie in bad light,” the lawyer stated.
“We are adamant that the judgement delivered in court is completely substantially different from the court copy because it was aimed at portraying Jowie guilty and at the court of appeal He will be vindicated.”
While Maintaining that Jowie is still innocent, his lawyer stated that the judge built a mountain out of evidence especially around those khaki shorts.
“She had to build a mountain on those khaki shorts because the only thing she had was to like Jowie to the death of Monica purportedly because a spot of blood of Monica DNA on the Khaki shorts was the only link. Apart from all the rubbish circumstantial evidence that the court had to lay its case on,” the lawyer stated.
He added that during the hearing the prosecution failed to produce photos of the shorts that Jowie wore on the material day even after being compelled by the court.
“The Prosecution own witness said that the shorts jowie wore had side pockets and the shorts brought to court had purportedly DNA and they did not have side pockets. On three occasions when the case was being handled by fromer trial judge James Wakiaga asked the Prosecution to bring the pictures that Jowie wore but failed to do so,” the lawyer said.
