Why court acquitted MP Babu Owino in DJ Evolve shooting

Embakasi East MP had been charged with misusing his firearm in the shooting of DJ Evolve.

Embakasi East MP Babu Owino was Tuesday, August 29, 2023 acquitted on the charge of misuse of a firearm in the shooting of DJ Evolve.

The acquittal came after a two-year legal battle, during which the court noted that the prosecution had failed to provide sufficient evidence to prove that Babu Owino had shot DJ Evolve.

In his ruling, Milimani Senior Principal Magistrate Bernard Ochoi said that the prosecution had failed to prove its case beyond a reasonable doubt. He said that the prosecution had not presented any evidence to show that Babu Owino had a gun on the night of the shooting, or that he had fired the gun that hit DJ Evolve.

DJ Evolve, who was shot in the neck in January 2020, testified in court that he did not see Babu Owino with a gun on the night of the shooting. He further told the court he did not know who shot him.

The prosecution had said that the Embakasi East MP shot DJ Evolve after a disagreement at a Nairobi nightclub. However, the prosecution’s case was weakened by the lack of eyewitnesses and the absence of any forensic evidence linking Babu Owino to the shooting.

Babu Owino’s acquittal is a major victory for the MP, who has been fighting the charges since January 2020, and a blow to the prosecution, which had been confident of securing a conviction.
